Section 1

Acceptance of terms

By accessing or using Plainview ("the Tool"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Tool.

These terms constitute a legally binding agreement between you ("User") and the operator of this Tool.

Section 2

Nature of service

2.1 Educational tool only

Plainview is provided for educational and informational purposes only. It is designed to help you understand potential investment scenarios using historical data and South African regulatory figures.

2.2 Not financial advice

Nothing in this Tool constitutes financial advice, investment advice or recommendations, tax advice, legal advice, an offer to sell or solicitation to buy securities, or professional financial planning services.

2.3 Nature of operator

Plainview is an independent, privately operated financial education service. The operator is not a financial institution, registered financial adviser, or investment company, and does not hold any financial services licences under the Financial Advisory and Intermediary Services Act, 37 of 2002 (FAIS Act).

Section 3

Your responsibilities

3.1 Consult professionals

You must consult a qualified, FAIS-registered financial adviser before making any investment decisions. This Tool cannot and does not replace professional financial advice tailored to your circumstances.

3.2 Verify information

You are responsible for independently verifying all data and calculations. Do not rely solely on this Tool for investment decisions.

3.3 Understand risks

You acknowledge that all investments carry risk, including the risk of loss of capital. Past performance is not indicative of future results.

3.4 Appropriate use

You agree to use this Tool only for lawful, personal purposes and in accordance with these Terms.

Section 4

Data sources and accuracy

4.1 Third-party data

ETF performance data is sourced from publicly available information, primarily EasyEquities Compare. We have no control over the accuracy, completeness, or timeliness of third-party data. SARS tax figures are sourced from sars.gov.za and updated annually.

4.2 No guarantees

We make no guarantees regarding the accuracy of data, calculations, or projections; the completeness of information; the timeliness of data; the suitability of any investment strategy; or future investment performance.

4.3 Historical data limitations

All projections are based on historical performance. Past performance is not a guarantee of future results. Market conditions change, and historical returns may not continue.

4.4 Calculation methodology

The Tool applies adjustments to historical returns (mean reversion, TER deductions, inflation) to produce more conservative projections. These adjustments are estimates and may not accurately predict future performance.

Section 5

Disclaimers and limitation of liability

5.1 As-is basis

This Tool is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.

5.2 No liability for losses

We are not liable for any financial losses resulting from investment decisions made based on this Tool; errors or inaccuracies in data or calculations; service interruptions or technical failures; or any direct, indirect, incidental, or consequential damages.

5.3 Maximum liability

To the maximum extent permitted by South African law, our total liability for any claims arising from your use of this Tool shall not exceed the total subscription fees paid in the 12 months preceding the claim.

5.4 Tax implications

We provide no advice regarding tax implications. Tax laws are complex and subject to change. Consult a qualified tax practitioner.

Section 6

Prohibited uses

You may not redistribute, resell, or share access to the Tool; use the Tool to provide financial advice to third parties; reverse-engineer, decompile, or extract source code or calculation logic; use automated tools to access the Tool; misrepresent the Tool as professional financial planning software; or use the Tool for any illegal or unauthorised purpose.

Section 7

Intellectual property

All content, features, and functionality of the Tool — including calculation logic, projection algorithms, user interface design, and code — are the exclusive intellectual property of the operator and are protected under applicable copyright and intellectual property law.

Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Tool for personal, non-commercial purposes only.

Strictly prohibited

Extracting, copying, or reproducing any calculation logic or algorithm; reverse-engineering any part of the application; using the methodology in a competing or derivative product; or scraping outputs — are all strictly prohibited without prior written consent.

Section 8

Indemnification

You agree to indemnify and hold harmless the Tool operator from any claims, liabilities, damages, or expenses arising from your use or misuse of the Tool, your violation of these Terms, your investment decisions, or any claims by third parties related to your use.

Section 9

Payment and subscription

9.1 Pricing

Access to the Tool requires a monthly subscription of R99/month. Payment is processed through secure third-party payment providers.

9.2 Subscription terms

By subscribing you agree to recurring monthly charges until cancellation, automatic billing on the same day each month, and responsibility for maintaining valid payment information.

9.3 Cancellation

You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

9.4 Limited capacity

Total subscriptions are capped at 10,000 active users. Once capacity is reached, new signups are placed on a waitlist.

9.5 No refunds

Monthly subscription fees are non-refundable except as required by South African consumer protection law, including the Consumer Protection Act, 68 of 2008. consumer protection law.

9.6 Service modifications

We reserve the right to modify subscription pricing with 30 days' notice to existing subscribers. We reserve the right to modify, suspend, or discontinue the Tool at any time, with reasonable notice where possible.

Section 10

Privacy and data (POPIA)

We process personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA). The following applies:

  • Information collected: Name, email address, and calculator data, for account management, subscription billing, transactional email, and service delivery.
  • Calculation data: Your calculator inputs and projections are stored securely in AWS DynamoDB, encrypted at rest, and accessible only to your authenticated account.
  • Third-party processors: Payment processing (PayFast), authentication (AWS Cognito), data storage (AWS DynamoDB), and transactional email (AWS SES). Each processor handles only the minimum information necessary.
  • No selling of data: We do not sell, rent, or share your personal information with any third party for marketing purposes.
  • Your rights under POPIA: You have the right to access, correct, or request deletion of your personal information. To exercise these rights, contact us via the contact form on the homepage.
  • Retention: Account and calculator data is retained for the duration of your subscription and deleted within 30 days of a verified deletion request.

Sections 11–16

General provisions

Changes to terms

We may modify these Terms at any time. Material changes will be notified via email with at least 30 days' notice. Continued use of the service after the effective date constitutes acceptance of the modified Terms.

Termination

We may terminate or suspend your access at any time for violation of these Terms.

Governing law

These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of South African courts.

Severability

If any provision is found invalid, the remaining provisions continue in full force.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement regarding your use of the Tool.
